To oppose a Trademark - you have 2 months to oppose from when a trademark is first advertised. The trademark is typically advertised 5 months after the application is placed,
You can search for trademarks in the ATMOS system - to do so login as a guest and search the keywords.
Find the trademark e.g. Pirate Cartel and check it's status.
When the status changes from Accepted - Awaiting Advertisement to Accepted - Advertised can opposition to the trademark be applied. You have 2 months to oppose from this point in time.
To oppose a Trademark:
1. Login to e-services with IP Australia (saved in LastPass)
2. Go to Trademark > General Service Request > Request Category Opposition
Request Type: File a notice of intention to oppose registration of a trademark
3. You will need to fill out a Official IP Australia Notice of Intention to Oppose form (attached)
On the form Part 1 Formality Details enter the Trademark details for which you are opposing. The fee is $250
Part 2 Type of opposition Proceeding is opposition to: Registration of the above trade mark.
4. File this.
5. Once a notice of intention to oppose has been filed a statement of grounds and particulars (the reasons for opposing the trademark) will need to be filed.
From here the trademark applicant can then defend their trademark application.
