Sale Or Supply Of Liquor To A Minor - Liquor Act Section 114:
(i) A person shall not sell or supply liquor to a person under the age of 18 years -- Maximum penalty $5,000.00
(ii) A licensee shall not, on the licensed premises, allow liquor to be sold or supplied to a person under the age of 18 years. Maximum penalty $5,000
(iii) A person shall not obtain liquor from licensed premises on behalf of a person under the age of 18 years. Maximum penalty $5,000
(iv) It is a defence to a prosecution for an offence under sub-section (1) or (4) if it is proved that the person to whom the liquor was sold or supplied, or on whose behalf it was obtained, was of or above the age of 14 years and that, before the liquor was sold, supplied or obtained, there was produced to the defendant, documentary evidence that might reasonably be accepted as applying to the person and as proving that the person was of or above the age of 18 years.
If it can be reasonably assumed that an adult is attempting to purchase liquor on behalf of a minor, liquor is not to be sold to that person regardless of his/her age.
REQUEST FOR IDENTIFICATION
If you have any doubts about the age of any person present on store premises, you must request proof of their age. It is Beer Cartel Policy to ask for proof of age if the customer looks under 25 years. If they cannot produce proof of their age, or you are not satisfied with that proof, you must refuse to serve them and ensure that they leave the store immediately.
Obligation to Provide Identification
A person reasonably suspected of being a minor is required to produce satisfactory evidence of their age on request.
Types of Identification
The Liquor Regulation specifies that the following are acceptable evidence of age:
(a) A current driver’s licence carrying the holders photograph and date of birth, showing an age greater than 18 years.
(b) a “proof of age” card bearing a photograph and date of birth, showing an age greater than 18 years
(c) A current passport, showing the date of birth of the holder.
Expired driver’s licences and passports are not acceptable forms of identification
ALL FORMS OF IDENTIFICATION MUST HAVE A PHOTOGRAPH
